Foster care in private and public law

FOSTER CARE IN PUBLIC AND IN PRIVATE LAW Abstract The diploma paper deals with the present legal regulations of foster care in private law as well as in public law. The institute of foster care is placed on the frontier of public and private law and the purpose of my diploma paper is to assess, after a complete analysis, which of these two law branches is the foster care closer to. The diploma paper is divided into nine chapters. The first chapter is dedicated to the institute of foster care in general. This chapter has to introduce the reader into the problems and to acquaint him with the basic way-outs. The second chapter defines the notion of foster care and its purpose. Also the historical way-outs are described there. We can see the progression of this institute, as we understand it these days, since 19th century. The essential modification came during the period of communism and the reinsertion of the institute of foster care came at the end of 90's in 20th century. The third chapter is about the present legal regulations of foster care in the legal order of Czech Republic. The sources of legal regulations of foster care, including international sources that govern family law, are characterized there. Long term foster-care and the temporary one - psychological aspects of the foster-parent view and child's view.

This thesis primarily deals with foster care. The readers are acquainted with the basic informations from the topic. Further on it deals with the issue of creating connections with foster parents. It points out differences and permanency of the realionship between the long term foster care and the temporary foster care. It outlines the specifics of psychological aspects in both forms of foster care on the side of the child and the foster parent himself. In the second part the qualitative proposal of research is submitted which is focused on children's experience with the foster care. It is trying to point out subjective view of children in their positive and negative form, due to the foster care, emotional anchoring in foster family and last but not least the children's view of transitions between families and problems connected to it. One of the outcomes of this research is to create hypotheses which will be used as a support for next research projects. Pedagogical aspects in the preparation of future foster parents in the Czech Republic

The thesis is devoted to the topic of preparatory courses for applicants for foster care. The aim of the thesis is to chart the course of professional preparation of future foster parents and replenish their subjective opinions. The theoretical part refers to the current legislative changes affecting the area of foster care in the Czech republic. It also deals with topics closely related to foster care, such as kinship care, contact with the biological parents or the identity of children in foster care. The following section is focused on the analysis of available training programs for foster parents, their specifics and the related methodological recommendations of Ministry of Labour and Social Affairs of the Czech Republic. Practical work was supported by DC Paprsek. By the form of semi-structured interviews with applicants for foster care was studied their subjective view of the importance and effectiveness of training courses.
The current system in alternative foster care for vulnerable children

My dissertation work deals with substitute foster care. It's mainly focused on summary of changes in law in the current systém and their contribution to practice. The main goal was to map out the area of substitute foster care from the very first references of foundlings of Bohemia and Moravia. The theoretical part is divided into four chapters that include history, reason of changes from the UN to the amendment of laws and their implementation. Further I describe all forms of substitute foster care in Czech republic including financing and education of foster parents. The last chapter of theoretical part I focused on the substitute foster care system in the UK which is the model for a similar system in the Czech republic. The practical part is dedicated to qualitative research that tries by using the semi-structured interviews to find out how the mentioned changes work in praxis and how they affect the work of social workers and foster parents. The praxis shows that the amendment helps the healthy development of the child however the praxis lacks a coherent tools of social work to its proper fulfillment and functionality.
